Constructive possession refers to a legal theory where an individual is considered to have possession of an item without having physical custody, typically when they have the power and intention to control it. This concept is often applied in criminal law to establish possession of contraband or illegal items found in areas over which a person has dominion or control, even if not directly on their person.
