Welcome to AnyLearn, a service provided by AnyLearn, Inc. (“AnyLearn,” “we,” “us,” or “our”). 5. Generated Content and User Content

  • Generated Content: The Service includes content generated by AI models. This content is provided for general informational purposes and should not be relied upon for any specific purpose without independent verification. Generated content may be powered by third-party APIs such as OpenAI’s AI models.

  • User Content: Users may submit, upload, or otherwise make available content through the Service. You retain ownership of any intellectual property rights that you hold in the User Content. By submitting User Content, you grant AnyLearn a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service.

AnyLearn utilizes a variety of third-party services to enhance your experience, including:

  • Google: We use Log in with Google and may display YouTube videos via the YouTube API. By using these features, you agree to Google’s Privacy Policy and YouTube’s Terms of Service available here and comply with their associated API policies.

  • Facebook: You may use Log in with Facebook to sign into the platform. In doing so, you agree to Facebook’s terms and conditions.

  • Search API Providers: We utilize search technology from third parties to facilitate intelligent content discovery, such as Meilisearch.

Your use of these third-party services through AnyLearn is subject to their respective terms of service and privacy policies.

By using the Service, you agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law;

  • Attempt to gain unauthorized access to the Service, other user accounts, or any computer systems or networks connected to any AnyLearn server through hacking, password mining, or any other means;

  • Use any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission.

8. Intellectual Property Rights

All content and materials available on the Service, including but not limited to text, graphics, website name, code, images, and logos, are the intellectual property of AnyLearn or its licensors. ANYLEARN DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT. ANYLEARN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE FROM ERRORS OR VIRUSES. ANY USE OF THE SERVICE IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANYLEARN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY CONTENT OBTAINED FROM THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL ANYLEARN'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID ANYLEARN, IF ANY, IN THE PAST 12 MONTHS FOR THE SERVICE.

12. Indemnity

You agree to defend, indemnify, and hold harmless AnyLearn, its affiliates, and their respective officers, directors, employees, agents, and advisors from and against any and all claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your User Content.

13. Termination

AnyLearn may terminate or suspend your account and access to the Service at any time, with or without cause, with or without notice, effective immediately. Upon termination, you continue to be bound by these Terms.

14. Modifications to the Service

AnyLearn reserves the right to modify or discontinue, temporarily or permanently, the Service or any features or portions thereof without prior notice. You agree that AnyLearn will not be liable for any modification, suspension, or discontinuance of the Service or any part thereof.

15. Dispute Resolution and Arbitration

Arbitration Agreement: You and AnyLearn agree to resolve any disputes through final and binding arbitration, except as set forth under “Exceptions to Agreement to Arbitrate” below. Arbitration will be conducted by a neutral arbitrator rather than in a court by a judge or jury.

Exceptions to Agreement to Arbitrate: Either party may assert claims, if they qualify, in small claims court in Wilmington, Delaware, or any United States county where you live or work.

16. Governing Law

These Terms and any action related thereto will be governed by the laws of the State of Delaware without regard to its conflict of laws provisions.

17. General Terms

These Terms constitute the entire and exclusive understanding and agreement between AnyLearn and you regarding the Service, and these Terms supersede and replace any and all prior oral or written understandings or agreements between AnyLearn and you regarding the Service. If any provision of these Terms is held invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.
